1. Introduction

Welcome to Adam's Garden ("Platform", "Service", "we", "us", or "our"). These Terms and Conditions govern your use of our AI-powered personal assistant platform and related services.

By accessing or using Adam's Garden, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.

2. Definitions

• "Garden" refers to your personal AI workspace within the Platform.
• "AI Assistant" refers to the AI-powered agent assigned to your Garden.
• "Projects" refers to applications, automations, or creations built within your Garden.
• "Family Members" refers to users you invite to share your Garden or create sub-Gardens.
• "User Data" refers to all information, content, and data you provide or generate through the Service.

3. Account Registration

To use Adam's Garden, you must create an account and set up your Garden. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

4. Your Garden & AI Assistant

When you create a Garden, you will:

• Choose a name for your Garden and AI Assistant
• Have the option to connect your own OpenClaw instance or use our managed service
• Be able to invite Family Members to your Garden
• Have full control over your Garden's projects and settings

5. Data Ownership & Rights

Your Data, Your Ownership: You retain full ownership of all User Data you create, upload, or generate through the Service. This includes:

• Projects and applications you build
• Conversations with your AI Assistant
• Files, documents, and media you upload
• Custom configurations and automations

License to Us: By using the Service, you grant us a limited, non-exclusive license to:

• Store and process your data to provide the Service
• Use anonymized, aggregated data to improve our services
• Display your shared Projects in the marketplace (with your explicit consent)

6. Project Sharing & Marketplace

You may choose to share Projects on the Adam's Garden marketplace. When sharing:

• You retain ownership of your original work
• You grant other users a license to use shared Projects according to the license type you select
• You are responsible for ensuring you have rights to share any included content
• We may feature, promote, or categorize shared Projects

7. Advertising & Monetization

To support the Platform, we may display advertisements. You acknowledge that:

• We may use anonymized usage data to show relevant advertisements
• We will never sell your personal data to third parties
• You may opt out of personalized advertising in your settings
• Premium tiers may offer ad-free experiences

8. Privacy & GDPR Compliance

We are committed to protecting your privacy in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. You have the right to:

• Access: Request a copy of your personal data
• Rectification: Correct inaccurate personal data
• Erasure: Request deletion of your data ("right to be forgotten")
• Portability: Export your data in a machine-readable format
• Object: Object to processing of your data for certain purposes
• Restrict: Request restriction of processing

9. Family Sharing

When you invite Family Members to your Garden:

• Each Family Member gets their own private sub-Garden
• Family Members cannot access your projects or data without explicit sharing
• You may receive fun, anonymized updates about family members' progress
• You can revoke access at any time
• Family Members can leave your Garden and create their own independent Garden

10. Acceptable Use

You agree not to use Adam's Garden to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Distribute malware, spam, or harmful content
• Attempt to gain unauthorized access to other Gardens
• Use the Service for illegal activities
• Harass, abuse, or harm others

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features with reasonable notice. For self-hosted OpenClaw instances, you are responsible for maintaining your own infrastructure.

12. Limitation of Liability

To the maximum extent permitted by UK law, Adam's Garden shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Termination

You may terminate your account at any time. Upon termination:

• You may export your data before deletion
• We will delete your data within 30 days (unless legally required to retain)
• Shared Projects may remain in the marketplace unless you withdraw them first
• Family Members will be notified and may create their own independent Gardens

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the Platform. Continued use after changes constitutes acceptance of the new Terms.
